赔偿义务人因同一生态环境损害行为需要承担行政责任或者刑事责任的，不影响其依法承担生态环境损害赔偿责任。赔偿义务人的财产不足以同时承担生态环境损害赔偿责任和缴纳罚款、罚金时，优先用于承担生态环境损害赔偿责任。司法机关在办理案件追究相关责任人环境犯罪刑事责任时，通常会将生态环境损害赔偿责任履行情况作为量刑情节予以考量。

 If an obligor is liable for administrative or criminal liability for the same ecological and environmental damage, it shall not be affected by its liability for ecological and environmental damage in accordance with the law. When the obligor's property liable for compensation is insufficient to cover both the liability for ecological and environmental damage and the payment of fines and penalties, priority will be given to the liability for ecological and environmental damage. The judicial authorities will usually consider the fulfillment of the responsibility for compensation for ecological and environmental damage as a sentencing circumstance when handling cases to pursue the criminal responsibility of the person responsible for environmental crimes.
